Suffolk County DWI 

In Suffolk County, those arrested for driving while intoxicated or driving with ability impaired due to alcohol will usually be brought to the Suffolk County First District Court in Central Islip to be brought before a judge and arraigned. Those arrested on the east end of Suffolk County will be brought to one of the east end town or village courts. These courts include the Southampton Town Court, East Hampton Town court, Riverhead Town Court, Southold Town Court, Westhampton Village Court and the Southampton Village Court. 

Misdemeanor DWI cases that are sent to the Suffolk County First District Court in Central Islip will be adjourned to one of the DWI parts on the fifth floor of the District Court. The Suffolk County DWI parts are specialized court rooms that handle only DWI cases. Felony cases returnable to Central Islip will usually be sent to the felony exam court room in an attempt to resolve the case pre indictment. Felony DWI cases that are presented to a Grand Jury and subsequently indicted will be transferred to the County Court in Riverhead.

Misdemeanor DWI cases returnable to one of the east end courts will remain the east end court. Felony cases returnable to one of the east end court will remain in that court until indictment. Upon an indictment, or upon an agreed upon pre indictment felony plea called a SCI plea, the case will be transferred to the County Court in Riverhead.
